The code ships. The law coughs.
Yesterday, having an idea was enough.
Then you had to know how to code.
Today, sometimes all it takes is telling an AI tool: “build me an app.”
Claude executes. Copilot completes. Cursor assembles. The code appears. Clean. Fast. Impressive.
Then a server-outage question hits the room at 5:58 p.m.: who owns that code?
The developer who prompted?
The company paying for the subscription?
The tool provider?
No one, if the human contribution is considered too weak?

The answer depends on the country, contracts, facts, the level of human intervention, project traceability, the developer’s role, the material reused, and sometimes court decisions still taking shape.
Giving instructions is not the same as creating
Many companies are already celebrating their AI productivity.
They are right to look at speed gains. But they often ignore the second dashboard: ownership, responsibility and proof.
Typing “develop an invoicing module” into an AI tool says very little about the human role in creation. Who designed the architecture? Who chose the dependencies? Who arbitrated the business logic? Who corrected the errors? Who tested the result? Who validated compliance? Who documented the choices?
In January 2025, the U.S. Copyright Office published Part 2 of its AI and copyright report, focused on the copyrightability of outputs created using generative AI; it states that protection depends on sufficient human contribution to expressive elements. Reuters also reported that in March 2025, a U.S. federal appeals court affirmed that an AI-generated work without human input could not be copyrighted under U.S. law. (Reuters)
In Europe, the European Parliament notes that the EU currently lacks specific rules on the copyrightability of AI-generated works, while European case law and national developments point toward the need for significant human creativity. (European Parliament)
A company shipping AI-generated code without documenting the exact role of humans is walking on unstable ground.
Contracts do not replace copyright law
GitHub states in its Copilot FAQ that, if an output is capable of being owned, GitHub does not claim ownership of it. (GitHub)
That matters.
But it is only one part of the issue.
A contract may organize the relationship between the user and the AI tool provider. It may state that the provider does not claim ownership of the output. It may allocate responsibilities. It may limit certain warranties. It may shift some risks toward the user.
But a contract with an AI provider does not automatically create copyright protection for an output that may lack sufficient human contribution.
This is where many teams get it wrong.
They read: “the provider does not own your output.”
They translate: “therefore we own everything.”
Between those two sentences lies a strategic gap.
The risk is not only losing a lawsuit. It is also discovering, during due diligence, a cybersecurity audit, fundraising, a company sale or a commercial dispute, that no one can properly explain the origin, human contribution and rights attached to part of the delivered code.
The invisible developer becomes a risk
AI does not kill the developer.
It kills the invisible developer.
The one who does not document.
The one who does not decide.
The one who lets the machine produce without taking control again.
The one who copy-pastes code because it compiles.
The one who confuses fast output with a mastered asset.
The one who can no longer say: “this part came from me, this part came from the tool, this part was modified, this part was tested, this part was validated.”
The AI-augmented developer must become more visible, not less.
Their value no longer lies only in producing lines of code. It shifts toward architecture, framing, review, correction, integration, security, compliance, quality, documentation and arbitration.
In simple terms: the human regains value when the human regains the decision.
In my book, I explain that creativity, invention and innovation are not the same thing (my book, chapter 3). That distinction becomes central with AI.
Creativity may be an idea.
Invention may be a new technical creation.
Innovation requires implementation.
With AI-generated code, many companies rush into implementation without clarifying creation. They innovate on the surface while weakening intellectual property underneath.
The Wild West always starts with enthusiastic cowboys
The digital Wild West is not filled with outlaws carrying revolvers.
It is filled with teams in a hurry.
A CTO wants to go faster.
A developer wants to ship cleaner code.
A product manager wants to reduce time-to-market.
A CEO wants to announce productivity gains.
An investor wants to see more features with fewer resources.
Everyone has a good reason to accelerate.
And no one wants to slow down to answer a legal question that sounds theoretical.
Until it stops being theoretical.
The issue is not the use of Claude, Copilot, Cursor or other tools. The issue is the absence of governance around their use.
A serious company should not only ask: “How much time did we save?”
It should also ask:
Who designed the architecture?
Which prompts were used?
Which files were generated?
Which parts were rewritten by a human?
Which tests were executed?
Which open-source dependencies were introduced?
Which license analysis was performed?
Which security review was completed?
Which final human decision validated the code?
Without these elements, AI productivity looks like a rocket whose bolts nobody inspected.
Code without clear authorship can become a fragile asset
Software is not just a set of files.
It is an asset.
It can be sold, audited, licensed, valued, integrated into a platform, transferred to a client, reviewed by an investor, challenged by a competitor or dissected by a lawyer.
If a company cannot demonstrate its creation chain, it turns operational acceleration into asset risk.
In the coming years, tracing human contribution may become a normal reflex in development teams, like unit tests, code reviews, vulnerability scans and open-source license checks.
AI code should not enter production without leaving a trail.
Not because it is bad.
Because it is powerful.
And the more powerful a tool becomes, the clearer responsibility around its use must be.
Traceability becomes an innovation skill
Many leaders still see documentation as an administrative burden.
Strategic error.
Documentation becomes an innovation skill.
Documenting is not slowing innovation down.
It is making innovation defensible.
It allows a company to explain how a decision was made.
It separates a prototype from an asset.
It shows the human contribution.
It allows a company to tell a client: “this is how the code was designed, generated, reviewed, secured and validated.”
It allows a company to tell an investor: “we have a clear policy for using AI in development.”
It allows a lawyer to see the contribution chain.
The AI-augmented developer must therefore learn a new discipline: writing less code at times, but leaving better proof of what they actually created, chose and validated.
A prompt is not a magic wand
A prompt is an intention.
Architecture is a decision.
Code review is responsibility.
Testing is evidence.
Correction is contribution.
Validation is commitment.
A prompt alone is sometimes like ordering at a restaurant: “bring me something good.”
Nobody becomes a Michelin-starred chef by placing an order.
The chef chooses the ingredients, builds the balance, adjusts the cooking, corrects the seasoning and takes responsibility for the plate.
In software development, the AI-augmented developer must do the same.
They should not merely ask for code.
They must understand it.
They must reshape it.
They must test it.
They must intellectually sign it.
What companies should put in place
A simple governance model for AI-assisted development could rely on five reflexes.
First: define authorized uses. Not all tools are equal. Not all contexts are equal. An internal prototype, a client module, critical code, cybersecurity components or commercial software should not be treated the same way.
Second: keep track of human contributions. This does not mean archiving everything obsessively. It means being able to explain key decisions: architecture, technical choices, refactoring, testing and validation.
Third: control dependencies and licenses. The risk is not only about the author of generated code. It also concerns possible fragments, structures or dependencies that create unexpected obligations.
Fourth: impose human review. AI-generated code should go through serious review, like any code produced by a developer. AI must not become a no-rule zone just because it saves time.
Fifth: train teams. A developer using AI without understanding intellectual property, security, licensing and confidentiality risks becomes an involuntary risk.
Speed without mastery becomes expensive
The companies that use AI best will not necessarily be the ones generating the most code.
They will be the ones turning speed into mastery.
Speed alone produces volume.
Mastery produces assets.
Speed alone impresses in demos.
Mastery reassures during audits.
Speed alone creates the illusion of a multiplied team.
Mastery builds an organization capable of innovating without losing control.
This is what many companies are discovering with generative AI: the tool increases production capacity, but it also increases the need for judgment.
AI does not remove human responsibility.
It makes it harder to hide.
The developer’s new signature
Tomorrow, developers will not be judged only on their ability to write code.
They will also be judged on their ability to prove they understand what they ship.
What they designed.
What they generated.
What they modified.
What they validated.
What they take responsibility for.
The professional signature of the AI-augmented developer could sound like this: “I used AI as a tool, but the decision, structure, validation and responsibility are mine.”
That is the real shift.
The winning company will not be the one letting AI produce in the dark.
It will be the one making the human contribution visible, traceable and defensible.
Your developer may just have written code that belongs to no one.
Or they may just have created a powerful asset.
The difference comes down to one word: proof.
